Class Action/Mass Tort Litigation

Overview

Todd & Weld’s broad litigation experience provides the versatility and expertise needed to prosecute and defend class actions and mass torts on behalf of clients in state and federal courts.

Our attorneys are exceptionally well positioned to handle class action and mass tort claims because of the diversity and depth of the firm's business litigation and tort practice, as well as our ability to effectively litigate all aspects of cases from inception through trial, and our skill and willingness to try those matters that cannot be fairly settled.

Examples of class actions and mass tort cases we have handled include:

  • Obtaining dismissals on behalf of universities of putative class actions involving tuition refund claims related to online course instruction necessitated by COVID-19
  • Persuading a Massachusetts state court judge to deny the request of a salesperson for a class action arbitration against his former auto dealership employer
  • Obtaining summary judgment defeating the complaint of numerous auto dealerships against the firm’s client, the exclusive distributor of a major auto manufacturer’s cars, parts, and accessories in New England, in a matter alleging violations of state and federal dealer protection laws, the federal Racketeer Influenced Corrupt Organization Act (RICO), and federal anti-trust laws
  • Representing several thousand New England homeowners against a manufacturer to recover property damages arising from a defective hose used for home heating, resulting in a $320 million national class settlement
