Gary O. Todd Speaks on Legal and Financial Issues in “Grey Divorce”

Todd & Weld partner Gary O. Todd recently served as a faculty member for the program “Grey Divorce: Advanced Legal, Financial, and Policy Issues in Later-Life Divorce,” at the Newburyport Art Association in Newburyport, Massachusetts.

The program examined the rapidly growing trend of “grey divorce,” divorce involving individuals over the age of 50. In 2024, grey divorces accounted for approximately 40% of divorces, compared to just 8% in 1990. The presentation explored why traditional divorce assumptions often fail in later-life cases and highlighted the unique legal, financial, and emotional considerations that arise.

Topics included:

  • Grey divorce and the empty-nester phenomenon
  • Inheritances received later in marriage
  • Property division and the Massachusetts Alimony Reform Act
  • Retirement assets already in payout status
  • Social Security considerations in divorce
  • Medicare and Medicaid implications
  • Emotional, ethical, and capacity concerns
  • The role of alternative dispute resolution (ADR)

Mr. Todd joined a distinguished faculty that included Evelyn J. Patsos, Associate Justice of the Massachusetts Probate and Family Court; Robert A. Jutras of Sheehan Schiavoni Jutras and Magliocchetti LLP; and Thomas J. Taranto of the Law Office of Thomas J. Taranto P.C..

The program provided legal professionals and advisors with practical guidance for navigating the complex issues that often arise in later-life divorce matters.
