Gary Todd, Rich Novitch to present on use of social media evidence in litigation

Gary O. Todd and Richard M. Novitch will present on social media evidence in family law and probate matters as part of a panel discussion hosted by the Greater Newburyport Bar Association.

The Oct. 7 program will address numerous topics, including conducting discovery for social media evidence, admissibility of information found on social media platforms, and potential civil and criminal consequences of using social media evidence.

The importance of these issues is highlighted by a case pending before the Massachusetts Supreme Judicial Court (Commonwealth v. Carrasquillo) that involves whether social media users have a reasonable expectation of privacy in their posts.  The court will hear oral argument in the case on Sept. 8.

Mr. Todd, a Founding Partner of the firm, is a frequent presenter at continuing legal education programs.  Concentrating his practice on family law and probate litigation, he has successfully negotiated, mediated, and tried numerous family law issues at the trial court and appellate levels, including divorce, custody, parental rights, complex support matters, property division, removal, modification, and contempt actions.

Mr. Novitch represents clients in all aspects of domestic relations law, including complex matrimonial matters and high net worth property division.  A frequent speaker on family law issues, he has extensive experience handling complex cases and issues on appeal, including matters before the Massachusetts Supreme Judicial Court and Massachusetts Appeals Court.
