David Rich, Gregory Browne secure defense verdict defeating $650K breach of contract claim
David Rich and Gregory Browne obtained a jury verdict rejecting a breach of contract claim by the owner/developer of a senior living facility in western Massachusetts.
The case involved a dispute over the design and construction of an assisted living facility in Westfield, Mass. The owner/developer claimed that the 58,000 square foot parking area built by the contractor (the firm’s client) failed prematurely because it was allegedly not constructed in accordance with the project specifications.
After a five-day trial in Hampden County Superior Court, the jury ruled in favor of the contractor after deliberating for less than 30 minutes.
