Todd & Weld Secures Appellate Victory Affirming Nearly $2.6 Million Breach of Contract Judgment

Todd & Weld attorneys David Rich and Greg Browne successfully secured a Massachusetts Appeals Court victory affirming a judgment in favor of the firm’s clients in a contract dispute arising from real estate development projects. The total combined award to the firm’s clients, including prejudgment interest, was just under $2.6 million. The Appeals Court affirmed this award.

The case involved participation agreements granting the plaintiffs ongoing economic interests in certain development projects. After the defendant ceased making required distributions, Todd & Weld pursued claims for breach of contract and obtained judgment in their clients’ favor following a bench trial in the Business Litigation Session, including a significant damages award and prejudgment interest. Earlier in the case, the Judge had granted partial summary judgment in plaintiffs’ favor on liability, determining that the defendant had breached the agreements when he failed to continue making distributions.

On appeal, the defendants challenged both liability and damages. However, the appellate court affirmed the trial court’s decisions in full, determining that summary judgment with respect to the defendant’s liability was proper and upholding the trial court’s damages award following trial.
