The recently published Spring 2019 Family Law Newsletter highlights a recent federal appeals court ruling that a man's bankruptcy filing did not protect from creditors his retirement account funded from his ex-spouse's 401(k) fund divided as part of their divorce.
The court determined that retirement funds received in a divorce are not exempt from creditors, unlike most retirement accounts which are protected against collection by creditors.
The newsletter, published by partner Gary Owen Todd, analyzes other important issues, such as when and how parents should talk about their finances with their adult children, and about the complexities of active military duty and child support.
