Massachusetts Lawyers Weekly published an article in its July 21, 2014 edition which was authored by Megan C. Deluhery, a partner with Todd & Weld, entitled "Plaintiff's Status is Germane to Any Defamation Case."
Drawing on her experience with defamation matters, Ms. Deluhery discusses considerations relevant to whether a publication is germane to a plaintiff's limited purpose public figure status, and so, whether the heightened actual malice standard will apply. The standard of care "is often outcome determinative."
Ms. Deluhery follows the issue through a number of recent case decisions and describes arguments on both sides from a recent successful case in which she represented the plaintiff.
