Max Stern was quoted in a Wall Street Journal article on his intent to file a lawsuit on behalf of Jack Montague challenging a February 2016 expulsion from Yale University.
The university dismissed Mr. Montague, a former captain of the school's men's basketball team, for alleged sexual misconduct involving a female student at the school.
Mr. Stern told the Journal that after the alleged sexual misconduct, the woman left Mr. Montague's room, then came back later and spent the night in his bed.
"I would say that's a slim case," he said.
The WSJ article ("Yale Basketball Player Disputes Expulsion in Sexual-Misconduct Case") was published March 14.
Mr. Stern said Yale was under pressure to punish Mr. Montague after the Association of American Universities released a survey in September 2015 on sexual assault at college campuses, including Yale.
