The article, entitled "Compelling Evidence from Non-Parties in Arbitration," describes the issues involved in obtaining evidence from non-parties in arbitration.
Mr. Cacace describes the uncertainty of the law in this area, where enforcement can be cumbersome and expensive. He suggests best practices and practical alternatives in dealing with the issues raised when compelling evidence from non-parties in arbitration.
