Julie E. Green obtained an order denying summary judgment to the NCAA in a defamation case pending in Massachusetts Superior Court.
Ms. Green, who represents the plaintiff, Timothy Cohane, persuaded the judge that issues of material fact are in dispute concerning the defamation claim, including under the challenging "actual malice" standard of proof, which requires evidence of knowledge that a statement was false, or that the statement was published with reckless disregard of whether it was false.
The plaintiff's claim is based on a statement in an NCAA report that he submitted "false evidence" in an internal appeal proceeding related to his departure as head basketball coach at Buffalo University.
Ms. Green has substantial experience handling a wide variety of civil litigation disputes in federal and state courts, including jury and bench trials, and in appellate matters.
