Jeffrey N. Catalano of Todd & Weld LLP was interviewed for the December 1, 2014 edition of Massachusetts Lawyers Weekly for a front-page article entitled "Med-mal lawyers shed new light on arbitration realities." The article discussed the many factors that plaintiff's counsel weigh before choosing to waive a jury trial in favor of arbitration in medical malpractice cases.
Mr. Catalano recently convinced an arbitrator to award his client $10 million in a wrongful-birth case, believed to be a record arbitration award for a med-mal case in Massachusetts. In the case which resulted in the $10 million award, the client gave birth to a daughter who later was diagnosed with tuberous sclerosis. The defendant neurologist had treated the plaintiff for seizures for 13 years, yet failed to diagnose the genetic condition that was passed on to her daughter.
