As reported in Massachusetts Lawyers Weekly on February 17, 2014, Todd & Weld obtained a settlement of $948,000 for two passengers in a van who were severely injured when the van was cut off by another vehicle, causing the van driver to swerve into the median and flip the vehicle.
The passengers brought personal injury claims against both the driver of the van and the driver of the other vehicle. The insurer of the van tendered the policy limits, but the driver of the other vehicle contested liability and asserted that the driver of the van caused the accident because of careless operation. The claims of both passengers were settled at mediation prior to pursuing a lawsuit.
