Jeffrey N. Catalano, Eric Asquith, and Christine R. Thompson obtained a $350,000 wrongful death settlement on behalf of the family of an 89-year-old woman who died after falling and breaking her hip in a nursing home, as reported in the Aug. 3, 2015 issue of Massachusetts Lawyers Weekly.
The woman was admitted in 2007 to the nursing home with Alzheimer's disease and dementia. In 2010, the woman fell near the nurse's station, breaking her hip and left finger.
The family alleged in the complaint that the nursing home failed to implement fall-protection measures, and failed to properly assess the woman's condition after her fall. According to the family, a nurse walked the woman back to her room despite her fractured hip, which exacerbated the woman's pain and suffering.
Two other nurses, according to the complaint, also failed to properly assess the woman's condition, and failed to immediately notify the woman's doctor or family.
Mr. Catalano, Mr. Asquith and Ms. Thompson concentrate their practices on personal injury law, including wrongful death and medical malpractice.
