In a decision dated August 28, 2014, the Eighth Circuit Court of Appeals reversed the 2013 dismissal of a case brought by Todd & Weld on behalf of its Jane Doe client against Sammy Hagar. Howard M. Cooper, David H. Rich, Edward Foye, and Benjamin J. Wish represent the plaintiff in a suit in which she claims that she was defamed by the defendant in his book RED My Uncensored Life in Rock when he falsely accused her of engaging in extortionate conduct after she became pregnant with his child. The child died shortly after birth. Ms. Doe alleges that Mr. Hagar's portrayal of the events in his book were false and heartless.
The Eighth Circuit found that Doe was entitled to a jury trial on the question of whether Hagar's book, which sold more than 250,000 copies in hard cover, libeled her by falsely depicting her as (in the words of the Eighth Circuit) a "schemer and a criminal." The case will now proceed to trial in the federal district court in Iowa.
