On April 29, 2015, the Massachusetts Superior Court's Business Litigation Session rendered a 77-page decision finding in favor of David H. Rich and Todd & Weld's client and against MetroWest Medical Center and Vanguard Health System after a month-long bench trial held in January 2015. The matter involved claims by Todd & Weld clients that MetroWest and Vanguard had breached certain contracts to create and develop a Brain & Spine Institute at MetroWest Medical Center's Leonard Morse campus.
In rendering its decision, the Business Litigation Session (Roach, J) found that the hospital's chief executive "either failed to use best efforts to comply with the Agreements or actively undermined the Institute's concept from (almost) its inception." The Court awarded $3 Million in lost profits damages to a medical practice, as well as $652,000 in damages arising from the hospital's breach of an agreement to pay for management services rendered by a management company associated with the medical practice, also represented by Todd & Weld. The Court also awarded three years of prejudgment statutory interest, bringing the total verdict to approximately $5 Million.
