Appeals Court Upholds Todd & Weld's Victory
In a dramatic and forceful 5-0 decision on May 7, the Massachusetts Supreme Judicial Court upheld the $2.1 Million jury verdict obtained for Todd and Weld LLP client, Judge Ernest B. Murphy in 2005. With interest, the judgment now stands at approximately $3.4 Million.
The decision holds in very powerful language that Todd and Weld LLP lawyers, Howard M. Cooper and David H. Rich, established to a jury by clear and convincing evidence that the Boston Herald and its reporter, David Wedge, libeled Judge Murphy with actual malice. The decision was widely reported on in the press. The case remains a ground-breaking case in which a public figure was able to satisfy one of the toughest burdens of proof existing in law.
