Tyler Chapman and Heidi Nadel of Todd & Weld Win Motions to Dismiss and Attorneys’ Fees for Clients
Tyler E. Chapman and Heidi A. Nadel, partners at Todd & Weld LLP, succeeded in dismissing a complaint filed against the firm's clients in Massachusetts Superior Court today. The complaint concerned allegations of malicious prosecution relating to a prior case among the parties in Land Court. As the Superior Court found, however, the complaint was barred as a matter of law by Massachusetts' “Anti-SLAPP” statute and for failure to state a claim upon which relief can be granted.
The Court also ruled that Todd & Weld could file a motion to recover a portion of its clients' attorneys' fees incurred in moving to dismiss the case.
