David Rich and Megan Deluhery Successfully Defend Against Motion for Preliminary Injunction

Todd & Weld attorneys David H. Rich and Megan C. Deluhery successfully defended a local insurance brokerage firm and a newly hired employee against a motion for preliminary injunction in Suffolk Superior Court. The motion sought to enforce
overly broad non-solicitation and non-acceptance covenants signed by the former employee while he was employed by a competitive insurance brokerage firm. The relief sought would have effectively barred certain clients from doing business with Todd & Weld's client.

Judge Janet Sanders, in one of her first opinions since joining the Business Litigation Session of Suffolk Superior Court, ruled that the plaintiff was not likely to succeed on its claims that the new employee had improperly solicited three of his longstanding
clients, reduced the non-solicitation period from two years to one year, and refused to enforce a provision restricting the former employee from accepting business from his former clients.
