Domestic Relations

Todd & Weld LLP offers a highly focused and experienced team approach to the broad range of issues presented in family law and related general equity litigation. A core group of attorneys and paralegals brings specialized knowledge and expertise to areas ranging from pre-marital agreements to separation and divorce issues, property division, custody and visitation disputes, modifications and contempt proceedings. Our expertise extends from the divorce context to both the prosecution and defense of actions involving the property and custodial rights of non-married cohabitants, to complex jurisdictional issues and international custody disputes. We also have the expertise to evaluate and handle cases on appeal and have been involved in cutting edge appellate decisions defining surrogate parenting agreements and the visitation rights of de facto parents.

Our attorneys have both extensive trial and negotiation skills, including the ability to analyze when alternative dispute resolution is appropriate, and can effectively mediate or arbitrate such cases. Whether in negotiations or at trial, we bring the ability to analyze and value the myriad of financial assets often at stake, including business interests, trusts, stock options, pension and profit sharing plans and other complex investments, as well as the tax consequences of both dividing assets and setting support obligations. We have developed a network of professionals with whom we work closely to give us specialized assistance in these areas.
  • Trial of divorce cases involving attribution of income to a non-working spouse and dissipation of assets.
  • Mediation and arbitration of cases involving the division of complex assets, including issues of vesting of pensions and stock options and “phantom” income. 
  • Both trial and negotiation of settlements in actions to divide real estate owned jointly by non-married cohabitants, including claims between both same sex and heterosexual couples involving both property and claims for services.
  • Trial of custody cases both allowing and prohibiting the removal of children for residency outside of Massachusetts, and obtaining the return of children to Massachusetts from other jurisdictions. 
  • Both negotiation and trial of cases involving the retention or division of inherited and gifted assets, including trusts, and analysis of income from these assets. 
  • Mediation and trial of cases involving the valuation of professional practices and both minority and majority interests in a myriad of businesses.
