Todd & Weld has extensive experience and expertise in the management of risk and the resolution of disputes in complex construction projects, both in the public and private sectors. We work with all members of the construction process, including owners, general contractors, design-build contractors, subcontractors, suppliers, and materialmen to help them navigate, avoid and mitigate the risks inherent in the construction industry. This process often begins at the bidding or contract negotiation phase of a project and continues through claims-management and, if necessary, post-project dispute resolution proceedings.
Our representation of owners has included developers of high-rise office buildings, residential complexes, and other significant projects throughout the Boston area. This representation focuses on managing owner-related issues such as negotiation and drafting of contracts, managing risks through the claims management process during a project, resolving disputes that affect the owner’s interest such as liens and related actions, and litigation and arbitration concerning defective work, payment, and delay-related claims. In addition, Todd & Weld has provided advice and litigation services to towns in connection with the development of waste-water treatment facilities and school projects. We also have experience representing institutions, such as universities, faced with risks associated with their development projects. We have also represented condominium associations and other private commercial and residential owners on a variety of construction-related matters.
A major portion of Todd & Weld’s construction practice is focused on representing general contractors on public and private projects. We have represented multiple joint ventures in connection with the management of disputes on a large public works projects, including the Big Dig Project. We have also provided advice on a regular basis to general contractors in connection with negotiations of contracts and provided general risk management advice in order to anticipate and avoid disputes by favorably positioning our clients under the terms of their contracts.
Todd & Weld’s broad experience in the construction industry also includes prosecuting claims on behalf of general contractors and subcontractors. In several instances, the claims or requests for equitable adjustments have sought tens of millions of dollars. Such representation included proceedings in mediations, before dispute resolution boards, in arbitrations and in litigation in various courts. We have extensive experience with perfecting and prosecuting both lien and bond claims under applicable statutory authority, which has led to a high degree of success in securing payment for subcontractors and materialmen even in circumstances where the general contractor is experiencing financial difficulties.
